Terms of Service

Folius is a service provided by Jamie Mill, trading as Folius. By creating an account or using Folius, you agree to these terms.

We may update these terms as the service develops. If a change materially affects your rights or an active paid membership, we will give reasonable notice before it takes effect.

Membership and billing

Folius offers one paid membership with monthly and annual billing options. Both billing options provide the same product features. The price, billing interval, currency and any applicable taxes are shown before you complete checkout.

You can start writing as a guest or create a Folius account for free. Free use includes creating and editing books, previewing print pages, and exporting EPUB, Markdown and a Folius backup. A paid membership unlocks PDF download, hosted images, static website export, collaboration, and public sharing.

Accepting an invitation to collaborate on another person’s book is free. Collaborators use their own accounts but share the book owner’s paid access for that book. Their access, and any public read-only link, depends on the owner’s membership.

Membership is personal and is not a team or organisation-wide licence. Collaboration is for people genuinely contributing to books the member owns, commissions, manages or publishes. You must not use it primarily to give others paid features for books they independently own or control; they need their own paid membership for those books.

Individual commercial use is allowed. We may limit systematic or high-volume use of one membership as a shared service for a business or organisation, normally after notice and an opportunity to change the use.

Your first payment is due when you subscribe. Your membership then renews automatically at the selected interval, and the payment method on file is charged, until you cancel it.

Polar Software, Inc. (“Polar”) is the merchant of record and authorised reseller for Folius purchases. Polar handles checkout, payment processing, applicable sales taxes, invoices, receipts and refunds. A purchase is also subject to the Polar Buyer Terms and Polar Privacy Policy.

You can manage or cancel your membership through the billing page in Folius, which links to Polar’s customer portal. Cancellation stops the next renewal. Unless a refund or immediate revocation is agreed, paid access continues until the end of the current billing period.

Refund requests are considered case by case. Nothing in these terms limits any refund, cancellation or withdrawal rights that you have under applicable law.

When paid access or a complimentary access period ends, you may continue to sign in, create, view and edit books, preview print pages, and export EPUB, Markdown and a Folius backup. Paid features may be limited or discontinued without active paid or complimentary access, including PDF and website export, hosted images, collaboration and public sharing. Where practical, we will give reasonable notice before removing stored images.

Acceptable use

Folius is for writing, editing, formatting and preparing books for publication. You must not use the service for unlawful content or activity. You must only add content that you own or have permission to use, including text, images and other uploaded material.

Subject to the membership and collaboration rules above, you may use Folius for personal or commercial purposes and may sell the books you create.

The code of the service is not open source, and you may not copy any part of it.

Intellectual property

You retain ownership of your content. You give Folius the limited permission needed to store, process, display and export it in order to provide the service and follow your instructions.

Service availability and publication

We aim to provide a reliable and continuing service, but do not guarantee that Folius will always be available or error-free. Keep your own copies of important source material and exported files.

Before publishing, distributing or printing, you are responsible for checking the complete final export for errors, including missing or overset text, unsuitable text or image sizes, page breaks, fonts, images, margins, bleed and metadata. Where appropriate, inspect a physical proof before a larger print run. You are responsible for the final publication decision and for meeting printer, distributor and publishing-platform requirements.

Suspension and termination

We may restrict features, suspend access or terminate an account for a material breach of these terms, including deliberate or repeated misuse of membership or collaboration, or where necessary to protect the service, users or comply with law. Except where immediate action is necessary, we will explain the reason and provide a reasonable opportunity to remedy the issue.

Liability

We are not responsible for losses that we did not cause, that were not reasonably foreseeable, or that result from publishing, distributing or printing output without checking it as described above.

For business or commercial use, to the extent permitted by law, we are not liable for lost profit, revenue, business, opportunity, savings, goodwill or data, or for indirect or consequential loss. Our total liability will not exceed the membership fees paid in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, applicable consumer rights, or any other liability that cannot lawfully be excluded or limited.
